In the same way فى النَّفَقَةِ is said of expense, and فِى مَعِيشَتِهِ of a man's means of subsistence.

Abu-l-Laḥḥám Eth-Thaʿlebee says:
shāhidعَلَى الحَكَمِ المَأْتِىِّ يَوْمًا إِذَا قَضَىقَضِيَّتَهُ أَن لَّا يَجُورَ وَيَقْصِدُ
— meaning that it is incumbent on the judge who is come to, on any day when he decides a case, not to deviate from what is right, but to act with justice, or equity.
Akh says he means وَيَنْبَغِى أَنْ يَقْصِدَ, but as he makes an ellipsis and puts يقصد syntactically in the place of ينبغى, he makes it marfooʿ, because it stands in the place of what is [virtually] marfooʿ. Fr says he makes it marfooʿ because of the disagreement: since its meaning disagrees with that of the preceding verb, it is made to disagree in desinential syntax as well.
